The ATC did not, in fact, do their jobs; 20 seconds before the collision, they received an alert of the impending collision. Instead of ordering the CRJ to go around like one would for a TCAS resolution, they simply asked the helicopter - that was both lower than it, surrounded by lights and other aircraft, and probably using NVG's (which are also sensitive to glare) - if they had eyes on it. Although they said yes, it's obvious they had eyes on the wrong bird. And ATC gave the helicopter permission to do VISUAL separation. AT NIGHT!
ATC was the final line of defence, and they failed at their most fundamental duty by completely disregarding the alert, trusting the two pilots in the dead of night to de-conflict themselves. They failed to do so.
